Court Decision Allows Vietnam Vets to Sue Manufacturers

In 1984, Agent Orange manufacturers Dow Chemical, Monsanto (now Solutia), Diamond Shamrock, Hercules, Uniroyal, and others agreed to a class action settlement of $180 million to be paid to Vietnam veterans exposed to Agent Orange during the Vietnam war, and funds were distributed between 1988 and 1996.

Since no allowance was made for Vietnam vets who developed cancer or an illness after January 1, 1995, in June 2003 the US Supreme Court affirmed an appeals court decision which allowed Vietnam veterans diagnosed on or after that date with an illness or cancer related to Agent Orange to sue manufacturers of Agent Orange.

We believe that people who were exposed to Agent Orange in Vietnam and subsequently developed a related cancer or illness deserve to have an individual lawsuit filed. For that reason, we think that whenever possible, serious injury and death cases should not be lumped together with the claims of many other people in a class action. Each person deserves the attention of an individual lawsuit and that is what our clients can expect.
