Federal Court Welding Fumes Products Liability Litigation: MDL 1535The welding disease case that settled in September 2005 for more than $1 million was the first scheduled for trial among the 4,500 welding lawsuits that were consolidated in U.S. District Court in Cleveland as part of the federal court Multidistrict Litigation Number 1535, In re: Welding Fume Products Liability Litigation, United States District Court for the Northern District of Ohio, Eastern Division, case number 1:03-cv-17000 (“MDL 1535"), the Honorable Kathleen M. O'Malley, presiding. Moreover, plaintiffs’ lawyers estimate that there are an additional 5,000 welding lawsuits pending in various state courts around the nation. David Cohen, the federal court's Special Master in the welding cases, said the first MDL trial is now expected in November 2005. It is expected that Judge O'Malley may preside over three or four welding lawsuit trials before sending the thousands of remaining cases back to the various federal court districts where the cases were filed originally.
